Is Common Law Marriage the Same As Just Living With Someone?

No. Texas is one of the few states that recognizes common law marriage. However, to be in a common law marriage, you must hold yourself out as spouses. That is, you must call each other husband and wife. Just because you are living with a boyfriend or girlfriend does not mean you are calling each other husband and wife and does not mean you are in a common law marriage.
